SPECIAL EDITION OF THE AMERICAN LANDSCAPE'S WEDNESDAY WHAT IF — 01.24.2023

Editor’s Note No. 1:

The above video shows the Texas National Guard’s response to the Supreme Court’s order that they allow federal border patrol agents to remove the razor wire along its border at Eagle Pass by installing even more.

Moreover, Texas Governor Abbott defiantly declared to both the Supreme Court and the federal government that, “Texas will not back down!”

In our considered opinion here at The American Landscape, the Biden Administration has just presented to the GOP legislators in the State of New Mexico a unique opportunity upon which we cannot forego making a comment.

The question is … will the GOP in New Mexico be willing to display the necessary initiative and courage — similar to that which is currently being displayed by Texas — to seize this unique opportunity?

To summarize the conflict in Texas, the Biden Administration has — via their appeal to the Supreme Court to let federal border patrol agents resume cutting Texas’ razor wire at the border — placed itself in a stand-off with a state that is only seeking to protect its citizens from the dangers of the foreign invasion now taking place at its southern border with the treasonous blessing of President Biden and Secretary Mayorkas.

The question presented by the Texas case is:

If the federal government fails to fulfill its duty to protect the citizens of a state from a foreseeable danger, does that state have a constitutional right to fill that void left by the federal government by taking action of its own to protect its citizens?

Of course, in Monday’s 5-4 decision, the Supreme Court declared that a state like Texas does NOT have that constitutional authority to override the will of the federal government … apparently even if the practical effect of that federal “will” constitutes treason.

Yet, we at The American Landscape and many others elsewhere across America disagree!

Interestingly, this same principal holds true in the case of the federal government’s failure — i.e. refusal — to remove the overgrowth and deadfall in the vast forests it controls that foreseeably exposes the lives and property of the citizens of many Western states to the risk of destruction caused by the catastrophic wildfires that are consequent to this dereliction of duty.

When confronted by such dereliction by the federal government, shouldn’t the affected states — like New Mexico — have the constitutional right to fill this void by taking the appropriate actions on those “federal” forests that are necessary and appropriate to protect its citizens?

To that end, twenty years ago, New Mexico passed legislation to this effect that was predicated on what was then titled The Otero County Resolution which — like Texas — was ultimately defeated in federal court.

However, in light of the current conflict in Texas, New Mexico now has the opportunity to revive it former efforts to protect its citizens from the dangers of catastrophic fires caused by the ineptitude of federal government bureaucrats.

To that end, we have made an attempt to contact Steve Pearce, Chairman of the New Mexico GOP, by sending him the following email on January 23rd:

Hi Steve,

On January 10, you indicated in your email below that you were involved with Senate Bill 1. Please allow me to share with you that I was the original author of the Otero County Resolution upon which Senate Bill 1 was predicated (or, as some might say, plagiarized). And, on the basis of that foundation, let me share with you the following thoughts.

Yesterday, January 22nd,  the Supreme Court set the stage at the border of Texas for the Republican Party of New Mexico to possibly hit a home run against both the Biden Administration and Governor Grisham. 

As you probably already know, the Court said, in essence, that Texas does not have the authority to defend the lives and property of its citizens, even if the policies of the federal government expose those citizens to a grave threat of harm. 

In response, Governor Abbot tweeted:

“This is not over. Texas’ razor wire is an effective deterrent to the illegal crossings Biden encourages. I will continue to defend Texas’ constitutional authority to secure the border and prevent the Biden Admin from destroying our property.”

This is a perfect stage from which the State of New Mexico can relaunch a revised version of Senate Bill 1 that can ride with Texas on the issue of a state’s rights to protect the lives and property of its citizens from the effects of catastrophic fires when the federal government fails to perform its duty to do so. 

And for you, and the legislator you call upon, it will be incredibly easy to do so in the course of the current legislative session as follows: 

  1. Have a qualified legislator download the Otero County Resolution for transformation in legislation format with the help of someone like Tim Jennings; 

  2. Ask that legislator to modify the Otero County Resolution — NOT the inadequate Senate Bill 1 previously passed — as needed: i.e. to replace Otero County with the State of New Mexico;

  3. Submit the edited/revised Otero County Resolution in the form of a bill to be voted upon by the NM legislature; 

  4. Lobby its passage based on the argument that no legislator should want to vote against New Mexico’s desire to protect the lives and property of its citizens; and, finally,

  5. Submit the final legislation passed by the NM legislature to Governor Grisham for signature.

It will be interesting to see who in the legislature votes against the state’s rights to protect its citizens from catastrophic fires and, if it passes a vote in both houses, even more interesting to watch Grisham when she is placed in the uncomfortable position of having to side with Biden by being forced to veto legislation that seeks to protect the lives and property of New Mexico’s citizens from the threats of catastrophic fires due to federal agencies failing to clean up the over-growth and deadfall that creates the risk. 

In short, it very well could be a win-win situation for both you and the organization you run.

If handled correctly, it should likely garner national attention for you, your state’s GOP and the GOP legislator who carried it. And that is especially true in light of the national attention the Supreme Court’s recent Texas decision is making.
